1. Scope

These terms apply to the use of the website barrierzero.de and to the free services offered on it, in particular the free accessibility scan. They do not replace the contract for paid use of the platform.

2. Content of the website

The content on this website — including the guide on the BFSG and the European Accessibility Act — is provided for general information. It is not legal advice and creates no advisory relationship. Whether a specific product or service complies with legal requirements can only be assessed for the individual case.

3. Free scan

The free scan is a voluntary, non-binding service. By requesting it you confirm that you are entitled to have the specified domain tested. We crawl publicly accessible pages at a moderate rate and respect robots.txt directives for our crawler where technically feasible.

The report describes findings at the time of testing. It is not a certificate, an audit under a standard, or a statement of legal conformity. We may refuse or discontinue a scan, in particular where authorisation is unclear or the load would be unreasonable.

4. No guarantee of compliance

Accessibility testing — automated, agent-based or manual — cannot prove the absence of barriers. We describe what our tests found and are transparent about what they do not cover. We do not warrant that using BarrierZero results in compliance with the BFSG, the European Accessibility Act, WCAG, EN 301 549 or any other requirement.

5. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence we are liable only for breach of a material contractual obligation (an obligation whose fulfilment makes proper performance possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

6. Intellectual property

All content on this website is protected. Reports we produce for you may be used freely within your organisation and with your service providers.

7. Applicable law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin. Mandatory consumer protection provisions of your country of residence remain unaffected.
